Print firms run legal risk from FSC misuse

The Forest Stewardship Council (FSC) has told printweek.com that interest in the certification is at an "all-time high" among UK print firms, but that some risk legal action by misusing the FSC logo.

The environmental accreditation body said uptake of FSC across the UK had "more than doubled" over the past year, but added that confusion over the Chain of Custody scheme is leading to misuse.

According to FSC representative Rosie Teasdale, the increased demand for FSC branded stock has meant the non-certified printers run the risk of breaking the "chain".

"Many believe that they can print the FSC tick tree logo on any FSC certified paper they buy," said Teasdale. "However, only printers with their own FSC Chain of Custody certification are allowed to promote their use of FSC paper."

Teasdale also said there is a misconception "that it is acceptable for non-certified printers to label the paper as FSC certified as long as they don’t use the logo", when in fact the company name, acronym 'FSC' and logo all have strict controls on use.

But she added that the increased profile of the scheme has meant cases of misuse are more likely to come the group's attention, as clients and members of the public "are more aware".

To gain a Chain of Custody stamp and permission to use the trademarks, firms must employ an FSC-certified body to inspect and confirm every stage of the product's supply chain, from origin to end user.

Teasdale said: "Misuse of the trademarks is followed up and there is the option of taking legal action if required," though added that most printers are keen to gain legitimate certification once the system has been clarified.

I'm with a magazine printer in the US who is having a hard time understanding how the Chain of Custody Certification helps the environment. We buy paper form reputable suppliers who have substantial percentages of their paper FSC certified however, for our clients to place a logo, we have to spend substantial money just to confirm that any FSC paper is not switched out with non-FSC certified paper. We have a client that supplies their own paper and have secured FSC-certified paper but can't use the FSC logo since we are not certified. Why is this not treated just like recycled paper where the content of the actual paper is what matters? I would like some opinions here, which I 'm sure our industry is not short of.

I like the idea of FSC, you know, it gives you a nice warm feeling etc.  However once you get into the practicalities of production it becomes a major pain.  The whole system needs a bit more development before it can be of any significant use.
