David Gill settles out of court on day of hearing

Lawyers acting on behalf of Capital Print & Display and its former director David Gill have agreed an out of court settlement over charges relating to his conduct while working at the company.

Gill, along with eight members of his family, was due to appear at the High Court in London this morning accused of breach of fiduciary duty – the obligation to act in the best interests of another party, such as company shareholders or creditors.

At the hearing, which was brought by Begbies Traynor on behalf of Capital Print & Display and at which Gill did not attend, it was announced that a sum agreed by the two parties will be paid in full by Gill by 26 August 2009.

Although nine members of the Gill family were accused, only three are included in the payments – believed to be Gill, his wife and his father – the figure agreed will be paid by the three.

If the sum is not paid by 1 September 2009 the deputy judge Mr R Knowles called for a case management conference, at which the two parties will appear for direction.

Begbies Traynor, which was appointed as administrator to Capital in June 2008, had said that Gill could have to pay up to £1.6m.

Presumably creditors of Capital will get to know how much was paid.

You legal experts out there should be able to tell us simple business people how the personal liability of directors to creditors is affected by an allegation of "breach of fiduciary duty."

Also whether in cases of a similar type this condition could be considered as attracting a view from other authorities. Clearly there is no inference in this question that may connect other instances with this case.

 It will be interesting to know how much has been agreed on and how much of that will go to the people that actually need it, suppliers & employees alike.

Very disheartened that it has ended like this, as I feel those mentioned should be made to justify their actions

One has only got to look at his very smug picture to see this is not a man you can trust as far as you can throw him !

Sue me publically David ..I would like to see how far it gets you !

The UK print industry has got to put a stop to this sort of thing ..surely ???

His wife really should have told him not to buy that awful suit and tie. Not appropriate for a man in his seventies!

Madoff was sent to prison for 150 years and all he did was to rob greedy and avaricious people who should have known better. He just rode the markets, and every bubble bursts eventually. That is what capitalism is based upon.

But, knowingly having a silly hairstyle is much much worse. Not at all appropriate for a man of his age!

Charles Litton the Gill family are not happy with your comments you made and David's sons said they would personally like to meet you when you are in the neigbourhood, I can't say what else they said as it is too rude however the punt word is used quite a bit with spineless

Only problem with Jones is he is using the name Eamonn Brouder at the moment.

I blame our inept socialist government. What sort of an example does this kind of leadership set to the rest of us? The rot filters through parliament and then down to us lot. It's very hard to take things seriously these days and I'd jack all this in for a bit of good old fashioned Tory sleaze any day of the week. At least with all that 'getting to know you' going on in the early-mid nineties we were able to sustain our national population and identity. Never mind though. It is what it is.

Hi frazer, what's going on with you right now? You make a veiled third-party threat and offer us out for a drink and a chat with the Gill family, and we're decent folks and will happily pay our share. Why did they get themselves into such a mess - did you have anything to do with it? Are you some sort of consultant? Did you give them bad advice? I'm just curious, that's all. Obviously don't answer me if you think it'll get you into deeper water with the Gills.
